JinkoSolar Files Patent Infringement Lawsuit Against India’s Waaree

Chinese solar PV manufacturer JinkoSolar has filed a patent infringement lawsuit against its Indian peer Waaree Energies Limited and its subsidiary Waaree Solar Americas in the US District Court for the Southern District of Texas.  

JinkoSolar has filed the lawsuit through its subsidiaries Shanghai Jinko Green Energy Enterprise Management and Zhejiang Jinko Solar. 

The company accuses the ‘largest’ Indian solar PV manufacturer of infringing its n-type TOPCon patent US 11,824,136, which JinkoSolar says was granted in 2023.

Waaree has 13.3 GW of solar PV manufacturing capacity in India. It recently commissioned a 1.6 GW solar module production line in the US through Waaree Solar Americas as part of its plans to operate 5 GW of module manufacturing capacity in the country by 2027 (see Waaree’s 1.6 GW US Solar Module Manufacturing Fab Commissioned).  

With this lawsuit, JinkoSolar is expanding the web of its TOPCon patent infringement claims against solar PV manufacturers. It has already sued its compatriot LONGi Green Energy Technology for alleged infringement of its TOPCon patents in China, Japan and Australia. 

In response, LONGi has filed a counter lawsuit against JinkoSolar in the US and very recently in a Chinese court seeking the latter to stop the manufacture and sale of products using its TOPCon patents (see LONGi Files Patent Infringement Lawsuit Against JinkoSolar).  

JinkoSolar has also accused VSUN Solar USA and TOYO of infringing on its proprietary technology in a US court (see JinkoSolar Files Patent Infringements Case Against VSUN & TOYO).
